These Terms of Service ("Terms") govern your use of the website smartnesshome.com (the "Site"), operated by SmartnessHome ("we", "us"). By using the Site, you agree to these Terms.

1. What this Site is

The Site presents the mobile applications published by SmartnessHome and links to their stores and their own websites. Our applications are currently distributed on Google Play under the developer name "BVA Group". The Site itself does not require an account and does not sell anything.

2. App-specific terms

Each application has its own Terms of Service, which govern your use of that application:

• GetMyNews — getmynews.online/terms; its Content Policy and Copyright (DMCA) Policy apply to what members publish there
• Kalo.Quest — kalo.quest/terms
• Holdtotal — holdtotal.com/terms
• Vaxnext — vaxnext.com/en/terms
• Arcane78 — arcane78.com/terms
• Easy Mart — Easy Mart Terms of Use (free app, no subscription; adult U.S. audience).

Use of the applications is also governed by our End User License Agreement. GetMyNews is the only application with member accounts, member-published content and creator payouts: for that application, its own Terms prevail over these Terms and over the EULA in case of conflict.

3. Availability

Our applications and services are offered solely to residents of the United States. The Site is provided in English only.

4. Intellectual property

The Site and its content — text, design, logos, images and code — are the property of SmartnessHome and are protected by applicable intellectual-property laws. All rights reserved. You may not copy, reproduce, distribute, scrape, or create derivative works from the Site without our prior written permission. Google Play and the Google Play logo are trademarks of Google LLC. Other product names are trademarks of their respective owners.

5. Acceptable use

You agree not to misuse the Site — including attempting to disrupt it, probe or breach its security, or access it by automated means for purposes other than standard search-engine indexing.

6. Disclaimer and limitation of liability

The Site is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, SmartnessHome shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Site.

7. Governing law and disputes

These Terms are governed by French law — SMARTNESS HOME is a French company — without regard to conflict-of-law rules, and without prejudice to any mandatory consumer-protection rules of the state where you live. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute that mandatory law does not reserve to another forum shall be brought before the competent courts of Paris, France.

8. Changes

We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Continued use of the Site after a change constitutes acceptance of the new Terms.
