End User License Agreement

This End User License Agreement ("EULA") is a contract between you and SMARTNESS HOME (see our Legal Notice for the publisher's full identity) governing your use of our mobile applications: GetMyNews: Daily World News, Kalo.Quest: Calorie Counter, Holdtotal: Crypto Portfolio, Vaxnext: Vaccine Tracker, Arcane78: Tarot Card Reading, and any other application we publish that references this EULA (each, an "App"). By installing or using an App, you accept this EULA.

In short: the Apps are free, for your personal use, in the United States. Don't copy them, resell them, take them apart, or abuse them. Your content stays on your device; ads pay for the Apps. They come without warranties.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Apps, for your own non-commercial use, on devices you own or control, in the United States. The Apps are licensed, not sold; we retain all rights not expressly granted.

2. What you may not do

Copy, distribute, sell, rent, sublicense or otherwise transfer an App or any part of it;
Reverse engineer, decompile, disassemble or attempt to extract the source code of an App, except where that restriction is prohibited by applicable law;
Modify an App or create derivative works from it;
Scrape an App or access it by automated means, interfere with its operation, or circumvent its technical or advertising mechanisms;
Use an App in violation of applicable law or of the store terms under which you obtained it.

3. Your content and privacy

What you create in an App (journals, records, portfolios, questions) is yours and stays on your device; we claim no rights over it and hold no copy of it. Data handling is described in our Privacy Policy and in each App's own privacy policy, which prevail over this section in case of conflict.

4. Advertising and third-party services

The Apps are free and supported by advertising served by Google AdMob. The Apps also rely on the store and system services of the platform they run on (such as Google Play Services), which are governed by their own terms. We are not responsible for third-party services.

5. Updates and availability

We may update, change or discontinue an App, or any feature of it, at any time. Updates may be required for continued use. The Apps are offered solely to residents of the United States and are provided in English.

6. Age requirement

The Apps are not intended for children under 13. Each App states its own minimum age in its store listing and terms; some Apps require you to be 16 or 18 or older.

7. No warranty

The Apps are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. Content produced by the Apps is informational only: it is not medical, financial, investment, tax or legal advice, and it does not predict the future. Always rely on qualified professionals for such matters.

8. Limitation of liability

To the maximum extent permitted by law, SMARTNESS HOME shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or profits, arising out of or related to your use of an App. Where liability cannot be excluded, it is limited to the amount you paid for the App — which is zero.

9. Termination

This license ends automatically if you breach this EULA; we may also terminate it by withdrawing an App. You can end it at any time by uninstalling the App. Sections 2, 7, 8 and 10 survive termination.

10. Governing law and disputes

This EULA is governed by the same law and resolved in the same forums as our website Terms of Service, section 7: French law, without prejudice to any mandatory consumer-protection rules of the state where you live, with non-reserved disputes before the competent courts of Paris, France.
